I think there has been a misunderstanding here – Henry asked for an opinion on whether the Government was acting ultra vires by asking schools to add VAT to fees, in response to which we provided our understanding of how the necessary change to the law would be effected ie the legislative steps that would take place before the 2025 Finance Bill received Royal Assent.
We have not provided any advice to Henry regarding payment of the fees.

I am very interested to discover that you advised your client and our parent, Henry, that the Spring Term fee bill that we raised in respect of his two children due on or before 7th January 2025 was illegally adding VAT and that he should not pay it.
He has not!
Can you share your advice and confirm that you agreed it with HMRC? If you are right, we have a large sum of money to reclaim from HMRC and remit back to parents who will be very happy!
